Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through our online store by both consumers and entrepreneurs. A consumer refers to any natural person who enters into a legal transaction for purposes that do not fall under their commercial or independent professional activities. An entrepreneur is defined as a natural or legal person or a partnership with legal capacity who acts in the course of their commercial or independent professional activities when concluding a legal transaction.

For entrepreneurs, these GTC shall also apply to all future business relations without requiring separate reference. If entrepreneurs apply their own conflicting or supplementary general terms and conditions, we hereby reject their validity. Such terms shall only become part of the contract if we give our explicit written consent.

2. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with our company. The product presentations on our website represent a non-binding online catalog, not a binding offer. You may add products to your shopping cart without obligation and adjust your details at any time before submitting your binding order using the correction functions provided during the ordering process. By confirming the order, you submit a binding offer for the products in your shopping cart. We will send an automated email to confirm receipt of your order immediately after submission.

The contract becomes effective upon acceptance of your order, subject to product availability. Many of our products are handmade, so delivery may be delayed during periods of high demand. In exceptional cases where we are unable to fulfill your order, we will notify you promptly.

In the event of typographical errors, printing mistakes, or technical errors affecting product information or prices, we reserve the right to correct such errors. Any payments already received will be refunded without delay.

We may accept your order by sending a separate acceptance email or by dispatching the products. For specific payment methods, order acceptance follows the respective procedural requirements of the chosen payment option.

3. Contractual Language, Storage of Contract Details

The languages available for concluding the contract include German, English, and French. We store the contract details and will send you the order information and these GTC by email. You may access and review the GTC at any time on our website at erzgebirgehall.com. For security reasons, your past orders are not accessible online after completion.

4. Delivery Terms

Shipping charges apply in addition to the stated product prices, with details provided in the relevant product offers. Delivery is made exclusively via shipping services; in-store collection is not available. Shipping policies vary by destination region, with different terms applying to domestic and international deliveries. For shipments to non-EU countries, additional duties, taxes, and fees may apply in accordance with local regulations. International deliveries are handled by the national postal or parcel service of the destination country.

5. Payment

We offer various payment methods in our online store to accommodate customers from different regions. Payment processing follows the standard procedures of each selected payment method, with order fulfillment subject to successful payment completion. Payment validity and processing timelines are governed by the rules of the respective payment service providers.

6. Reservation of Ownership

Title to the products remains with us until full payment has been received. For entrepreneurs, this reservation of ownership applies until all outstanding claims from the current business relationship have been settled in full. Entrepreneurs may resell the goods under reservation of ownership in the ordinary course of business, and any claims arising from such resale up to the invoice amount shall be assigned to us. We reserve the right to collect outstanding receivables directly if payment obligations are not met.

7. Transport Damage

For consumers: If products arrive with visible transport damage, please report the damage to the delivery service immediately and contact us promptly. Failure to report damage immediately shall not affect your statutory rights or warranty claims, but you agree to assist us in pursuing claims against the carrier or insurer.

For entrepreneurs: Risk of accidental loss or damage to the goods passes to you upon handover to the shipping service provider. The obligation to inspect goods and report defects in accordance with applicable commercial law applies. Goods shall be deemed accepted if no timely notice of defects is given, unless the defect was not detectable upon reasonable inspection. This does not apply if we have fraudulently concealed the defect.

8. Warranty

All products purchased from our store are covered by statutory warranty provisions. The warranty period runs from the date of delivery. During the warranty period, defects covered by statutory provisions will be remedied free of charge. Your warranty rights are initially limited to supplementary performance. If supplementary performance fails, you may choose to cancel the contract or reduce the purchase price in accordance with applicable law.

You may contact our customer service for inquiries, complaints, or defect notifications through the contact channels provided on our website.

9. Product Information

Most of our products are handmade, so minor variations in color, design, and dimensions may occur. Please note that screen settings on different devices may cause differences in how product colors and details are displayed.

10. Liability

We are liable without limitation for damages resulting from loss of life, bodily injury, or harm to health; willful or grossly negligent breaches of duty; assumed warranty promises; or liability under applicable product liability laws.

For slight negligence in breaching fundamental contractual obligations, our liability is limited to typical foreseeable damages at the time of contract conclusion. All other claims for damages are excluded to the fullest extent permitted by law.

11. Code of Conduct

We comply with recognized quality and conduct standards for online retail. Detailed information about our code of conduct can be found at erzgebirgehall.com.

12. Dispute Resolution

The European Commission provides an online dispute resolution platform for consumer disputes. We are willing to participate in out-of-court dispute resolution proceedings before an independent consumer arbitration body in accordance with applicable regulations.

13. Final Provisions

These terms, along with all orders, deliveries, and related claims, are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For customers located abroad, mandatory consumer protection provisions under their local laws remain applicable.

For entrepreneurs, these terms are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes arising from the contractual relationship is our registered place of business, where required by applicable law.
